1. GENERAL PROVISIONS
U POST s. r. o., with its registered office at Bauerova 1205/7, 040 23 Košice, Company ID: 56 451 563, is a business entity registered in the Commercial Register of the Municipal Court Košice, Section: Sro, File No.: 60306/V (hereinafter referred to as “U POST” or the “Provider”).
The company carries out its business activities in accordance with the generally binding legal regulations of the Slovak Republic and international agreements, in particular the Convention on the Contract for the International Carriage of Goods by Road (CMR), as well as relevant European Union regulations.
These Shipping Terms represent conditions pursuant to § 27 of Act No. 324/2011 Coll. on Postal Services and on amendments to certain acts (hereinafter referred to as the “Postal Services Act”), and in accordance with the relevant provisions of Act No. 513/1991 Coll. Commercial Code, as amended (hereinafter referred to as the “Commercial Code”).
These Shipping Terms are valid from the moment a contractual relationship with the sender is concluded. Any changes are possible only on the basis of a written agreement.
Shipment distribution is carried out according to the valid price list and service types offered by U POST. All shipments are visibly marked with the U POST trade name and company logo. U POST guarantees the protection of postal secrecy in accordance with applicable legislation.
2. SCOPE OF SERVICES
2.1 U POST provides comprehensive services in the field of transport and delivery of postal shipments within Slovakia and internationally.
Basic transport and delivery services:
- Collection and delivery of shipments up to 10 ks
- Collection and delivery of shipments from 10 kg up to 50 kg
- Collection or delivery of international shipments up to 50 kg
- Special shipments (pallets, parts, goods made of wood, plastic, metal, etc.)
Additional services:
- Shipment insurance
- Cash on delivery
- Delivery notifications (SMS, push notifications, app)
- Handling of fragile goods
- Individually agreed services based on client needs
Express services:
- Delivery within Slovakia on the next working day
- International delivery within 2 to 7 days
- Pickup at the place of origin
- Delivery on a specific date
- Option to change the address during transport
- Delivery confirmation for the sender
- Online shipment tracking
- Personalized delivery based on agreement
2.2 Shipments are collected either at U POST collection points or via external carriers of U POST (hereinafter referred to as the “Carrier”) at a place agreed in advance with the sender.
2.3 Delivery notification means that if delivery is not successful, the Carrier leaves a notice for the recipient. This can be in the form of a written notice, phone call, SMS, or email, if U POST has the recipient’s contact details. If the recipient’s mailbox is full, not labeled, or not accessible (for example behind locked doors), it is not possible to leave a written notice.
2.4 The Carrier is not required to provide services such as phone calls, SMS, email notifications, or push messages, unless these services were ordered by the sender or included in the contract.
2.5 The sender acknowledges that the Carrier and U POST will use the recipient’s data only to the extent provided and only for the purpose of delivering the shipment.
2.6 Shipments can be sent to any address in the Slovak Republic or to selected countries. The recipient’s address must include their full name or company name, place of residence or registered office, including city, postal code, street name (if applicable), and house number. Shipments cannot be sent to PO boxes or poste restante.
2.7 Weight and Size Limits for Shipments
Weight limits:
Postal shipments intended for e-commerce transport must not exceed 50 kg, unless otherwise agreed in writing with the Provider.
Size limits:
- The maximum length of one side of the package is 150 cm
- The total of the package circumference (measured at the widest point) and the longest side must not exceed 300 cm
Standard shipment sizes:
- Small shipments (up to 2 kg): max. 30 × 20 × 10 cm
- Medium shipments (2 – 10 kg): max. 60 × 40 × 40 cm
- Large shipments (over 10 kg): max. 150 × 60 × 60 cm
2.8 International Shipment Transport
Maximum weight:
For international shipments, the maximum allowed weight is 50 kg per package. In some cases, the weight may be higher depending on the destination country and agreement with the Provider.
Maximum size:
International shipments usually follow the same limits as domestic ones, meaning a maximum length of 150 cm and a total circumference of 300 cm. Specific conditions may vary depending on the destination.
2.9 Oversized Shipments
If a shipment exceeds standard size or weight limits, it may be considered oversized. These shipments are subject to special conditions.
For oversized shipments, the transport conditions, including price and handling, must be agreed in advance.
2.9.1 Additional Charges
U POST reserves the right to charge extra fees in the following cases:
a) Overweight surcharge applies to each package weighing 30 kg or more.
b) Extra handling surcharge may apply in the following cases:
- packages packed in metal or wooden containers
- cylindrical items not packed in cardboard (e.g. barrels, tires, tubes)
- packages with the longest side over 150 cm or exceeding 150 × 60 × 60 cm
- packages that cannot be processed on sorting lines
- shipments containing ADR goods (dangerous goods), based on agreement
- irregularly shaped packages or poorly packed items
- shipments requiring handling by two people
- packages not properly packed or secured
- repacking done by U POST for safe transport
- additional COD collection after delivery (if not set at dispatch)
- correcting missing or incorrect address label data
- issuing a new label in required format or quality
- any shipment requiring special handling
- packages thinner than 4 cm
U POST may repackage shipments and charge an additional fee for materials used.
c) Customs surcharge: applies if the shipment requires customs clearance, according to the price list.
d) Crisis surcharge: may be charged during exceptional situations (e.g. emergency, crisis).
e) Fuel surcharge: adjusted based on fuel prices.
f) Toll surcharge: may change based on legal changes.
U POST may charge these surcharges separately or together, according to the price list.
Packaging Rules
The sender must ensure proper packaging based on weight, shape, content, and transport time.
The package must be strong, closed, and manageable by one person. It must resist pressure, temperature changes, and repeated handling.
The content must be protected with filling material. Bundling multiple packages together is not allowed.
The packaging must not endanger people or damage other shipments.
Marking a package as “Fragile” does not remove the sender’s responsibility. U POST does not guarantee orientation labels (e.g. “This side up”).
Goods for return or repair must be sent in original packaging, with old labels removed.
For liquids, plastic packaging is recommended. Glass must be specially protected.
2.9.2 Prohibited Items
The following items are excluded from transport:
a) improperly packed or labeled shipments, damaged packages, fragile items without protection
b) dangerous, toxic, narcotic, or radioactive substances, chemicals, gases, etc.
c) live animals and protected species, including plants
d) items that may endanger safety or damage other shipments (e.g. liquids like paint, glue)
e) offensive or inappropriate content (e.g. pornography, extremist materials)
f) cash and high-value items (money, securities, precious metals, jewelry, antiques), except jewelry up to 100 EUR
g) items prohibited by law (documents, fake goods, stolen goods)
h) biological material, medical waste, human or animal remains
i) weapons, ammunition, explosives, flammable materials
j) perishable goods (e.g. food)
k) items restricted by law (ADR goods)
If U POST finds any prohibited item, it is not responsible for damages. The company may refuse transport for safety or operational reasons.
If the sender provides undeclared or prohibited goods, U POST may cancel transport and return the shipment at the sender’s cost. The sender loses the right to claim damages.
If the sender knowingly sends prohibited goods without approval, no transport contract is created. The sender must pay all related costs and damages.
Carriers are not required to deliver to locations with poor access (e.g. mud, ice, no road access).
Senders can use Cash on Delivery (COD) service. Payments are transferred only to a euro account. Maximum COD amount is 5,000 EUR.
Maximum shipment value without insurance is 1,000 EUR. With insurance, up to 33,000 EUR.
If a shipment contains personal data and is lost, U POST is not responsible for related damages.
Shipment information is provided only to persons with the tracking number, via phone or online. Delivery information is available the next working day.

If a shipment cannot be returned to the Sender, U POST has the right to store it during a storage period. The storage period starts on the day after it is confirmed that the shipment cannot be returned. The storage period is 6 months. Storage and possible opening of the shipment follow the Postal Services Act.
U POST has the right to hold the shipment to secure payment of any due amounts from the Sender or Recipient, including shipping fees and related costs.
If, during storage or retention, the content of the shipment becomes damaged or there is a risk to health or safety, U POST may dispose of the shipment according to these terms.
If the shipment is sold, U POST will, if possible, give the Sender the remaining amount after deducting:
- storage costs
- sale-related costs
- unpaid service fees
Prices follow the current price list.
In case of crisis situations, natural disasters, or transport restrictions, U POST may temporarily limit or suspend standard delivery.
In such cases, U POST will inform the Sender and Recipient.
U POST is not responsible for force majeure events, and no compensation is provided.
U POST delivers shipments within Slovakia and to selected countries. It may refuse delivery to areas with restricted access (e.g. private areas, protected zones, or places requiring special permission).
The recipient has no legal right to:
- delivery at a specific time or day
- delivery to different or alternative locations
unless agreed in advance.
For multi-piece shipments (multi-colli), U POST may process them as separate single shipments for operational reasons.
If Cash on Delivery (COD) is used, U POST may collect the full amount when delivering any one package. The remaining packages will be delivered without additional payment collection.
U POST is not responsible if the recipient refuses a package after the COD amount has already been collected.
6. RIGHTS AND OBLIGATIONS OF THE PARTIES
U POST, as the Provider, has the following rights:
a) the right to payment for delivery services according to the valid price list, unless a different price is agreed in a separate contract
b) the right to ask the Recipient to specify the exact delivery location, if it is not clear from the address
c) the right to ask the Recipient to identify a person authorized to receive the shipment (authorized recipient)
d) the right to verify the identity of the Recipient or authorized person and to process necessary personal data for delivery
e) the right to refuse delivery if it is not possible and there is a risk of loss, theft, or damage
The Sender is required to:
a) properly label and pack the shipment according to these terms
b) use suitable packaging that meets these conditions
c) pay for the services according to the price list or agreed contract
The Recipient must take necessary steps to allow proper delivery, especially:
a) clearly mark the delivery address with correct information
b) allow safe and easy access for the Carrier
c) provide the name of the authorized recipient and specify the delivery location if needed
7. DISPOSAL OF SHIPMENT
The Carrier has the right to dispose of a shipment or part of it after the storage period, if one of the following applies:
a) the content is considered to have no value, is protected by postal secrecy, or is not suitable for storage or handling
b) the content has been damaged or degraded
c) the shipment cannot be delivered or returned to the Sender, and it should not be returned according to the contract
d) the Sender has already received compensation for damage or loss
If the Sender does not give instructions before the end of the storage period, U POST may sell the shipment in an appropriate way, especially if:
a) the shipment cannot be delivered or returned
b) there is a risk that the content will be damaged before delivery
The shipment may also be disposed of before the storage period ends if it is necessary to protect health, safety, or life.
The Sender must pay all costs and damages related to disposal, including:
- disposal costs
- costs related to claims from third parties
Disposal will be carried out in a way that U POST considers most appropriate.
The process will be done by at least two U POST employees or by an external qualified party.
A written record of the disposal will be created.
8. PRICING AND PAYMENT TERMS
Prices for shipment delivery and other services provided by U POST are set in the current price list.
U POST’s right to payment starts when the shipment is handed over. The price is based on the valid price list or individual agreement.
Payment for delivery is made:
- in cash
- by payment card
It is usually paid by the Sender, unless agreed that the Recipient will pay.
Bank transfer (invoice payment) is allowed only if there is a valid transport contract.
The invoicing method is defined in the contract.
Electronic invoices are sent to the email specified in the contract or agreed in writing.
If a paper invoice is requested, U POST may charge a fee.
The Sender can submit a complaint about invoice data (e.g. weight, extra charges) within 30 days from receiving the invoice.
The complaint must be sent in writing. After this period, the right to complain expires.
If Cash on Delivery (COD) is used, the Recipient must pay:
- in cash
- or by payment card accepted by U POST
U POST will transfer the COD amount to the Sender’s bank account or use it to settle the Sender’s debt.
If the bank blocks the payment, the transfer time may be delayed.
U POST accepts MasterCard and VISA.
U POST may verify the card and the identity of the cardholder.
In case of payment disputes or chargebacks, U POST has the right to request payment from the Sender, especially if:
- the card was invalid or altered
- the transaction was fraudulent
U POST is not responsible for disputes between the Sender and the cardholder (e.g. product quality).
If the bank reverses the payment, the Sender must repay the amount to U POST.
Card payment is available for COD shipments within Slovakia.
If COD is paid by card, a transaction fee may be added according to the price list or agreement.
The Sender or Recipient must check cash payments immediately in the presence of the Carrier or U POST employee.
Later complaints about cash payments will not be accepted.
U POST may charge a processing fee if one invoice is paid in multiple payments without prior agreement.
9. COMPLAINTS PROCEDURE
The complaints procedure is governed by a separate document called the Complaints Policy, which is an integral part of these terms.
The rules for submitting complaints, deadlines, and the way they are handled are defined only in this document.
10. CONTRACTUAL PENALTY AGREEMENT
If, during a claim for damages, it is found that the Sender handed over a shipment with a value higher than 1,000 EUR, and:
a) did not inform U POST in advance, or
b) declared a lower value than the real value,
and this prevented proper insurance of the shipment, the Sender must pay a contractual penalty equal to the difference between the real value and the insured value.
Applying the contractual penalty does not affect other rights of U POST, especially the right to claim damages.
U POST has the right to offset the contractual penalty against any claim for damages made by the Sender.
If the Sender ships items that are prohibited according to section 2.8.2 of these terms, the Sender must pay a contractual penalty equal to the damage caused to U POST.
11. PERSONAL DATA PROTECTION (GDPR)
U POST acts as a data controller when processing personal data under Article 4(7) of the GDPR and determines the purpose and means of processing.
For these Terms:
GDPR: Regulation (EU) 2016/679 on the protection of personal data
Personal Data: data such as name, surname, title, address, date of birth, ID number, ID details, bank details, phone number, email, and delivery-related data
Data Subject: any individual whose data is processed (Sender or Recipient)
11.1 Purpose and Legal Basis
U POST processes personal data for:
- Delivery of shipments – based on legitimate interest (Art. 6(1)(f))
- Handling complaints – based on legal obligation (Art. 6(1)(c))
- Accounting and taxes – based on legal obligation
- Legal claims and disputes – based on legal obligation
- Handling data subject rights – based on legal obligation
The Sender must inform the data subject (under GDPR Articles 13 and 14) that their data will be shared with U POST.
U POST may use processors (third parties) based on contracts under Article 28 GDPR.
The Data Protection Officer can be contacted in writing at the company address.
Access to personal data is allowed only to the verified data subject.
U POST may charge a fee for providing data in justified cases.
Personal data may be shared with authorities (courts, police, etc.) as required by law.
Rights of the data subject:
- right of access
- right to correction
- right to deletion
- right to object
- right to restrict processing
- right to data portability
- right to file a complaint with the authority
12. FINAL PROVISIONS
These Shipping Terms are an integral part of the transport contract between U POST and the Sender, unless agreed otherwise.
If there is any conflict between these Terms and an individual contract, the individual contract has priority.
U POST may update or change these Terms at any time, especially due to legal, technical, operational, or business changes.
Changes become effective on the day they are published at the U POST office, unless stated otherwise.
The Sender is responsible for checking updates to these Terms.
If the Sender continues to use U POST services after changes, it means they agree with the updated Terms.
Legal relationships arising from the transport contract between U POST and the Sender, which are not explicitly regulated in these Shipping Terms, are governed by the relevant provisions of Act No. 513/1991 Coll. Commercial Code, Act No. 324/2011 Coll. on Postal Services, and other generally binding legal regulations of the Slovak Republic.
